Hey Y’all,
One week ago today, my wife and I were going out to celebrate my friend’s 40th birthday. As we were leaving, I saw the breaking news that RBG had passed, got the attention of my wife, and somberly pointed to the television. And at that moment, we both looked at each other and thought very similar things. Yet another reminder that 2020 is the wooorst.

You may have not liked everything Ginsburg had to say, but her impact on the lives of American women is undeniable. She is also remembered for writing the majority opinion in the Olmstead decision (1999) which ensured the right of people with disabilities to live in their community. You can read more about it here in a great piece by Disability Scoop.
October Baseball
The end of the MLB season wraps up this Sunday. I did not have high hopes that we would finish the season, so as the regular season rounds the hot corner I am pleased to have been proved wrong.
As some of you know, I am a life long Dodgers fan, so for my “Boys in Blue” to shore up their 8th straight NL West Division title this week was definitely a highlight. I don’t know who you are rooting for, but it will surely be an October to remember. And there might even be some fantastic baseball too.

Go ahead, Danny. Get it.

In a disappointing result, D.S. v. Trumbull Bd. of Educ., decided on September 17, 2020, the U.S. Court of Appeals for the 2nd Circuit held that a functional behavioral assessment (“FBA”) is not an “evaluation” pursuant to the IDEA and that a parent is not entitled to an independent educational evaluation (“IEE”) upon disagreeing with an FBA conducted by the child’s school district.
